Privacy Policy
These terms and conditions govern your use of onlyhuman (Onlyhuman App) which you are being granted the right to use. The Onlyhuman App is provided by Epica Pty Ltd (ABN:78 612 184 335) (Company, we, us and our). Use of Onlyhuman App In order to use the Onlyhuman App, you must become a registered user by completing the sign-up form in the Onlyhuman App and agreeing to comply with these terms and conditions.
Emergency Situations
The Onlyhuman App is not appropriate if:
• you are experiencing an emotional or similar crisis;
• you or another person’s personal safety is at risk; and/or
• you require urgent medical treatment. If any one or more of these situations apply, you should seek immediate medical advice from an appropriately qualified healthcare professional.
Your Responsibilities
You promise us that your registration details are true, accurate and complete when you submit them and that you will keep them up to date. You are solely responsible for maintaining the security of your account and any use of Onlyhuman App that occurs in conjunction with your username and password. You must comply with any acceptable use or other policy published by us on the Onlyhuman App. You must not:
• attempt to gain unauthorised access to content through the Onlyhuman App;
• use a false email address, impersonate others or misrepresent your affiliation with others;
• share your Onlyhuman App login details with any other person or use the login details of any other person to access Onlyhuman App;
• interrupt or attempt to negatively impact or alter the operation of the Onlyhuman App in any way;
• use the Onlyhuman App or any of the materials made available through the Onlyhuman App in a way that violates applicable laws, that violates the intellectual property or other rights of us or others, or that is fraudulent, obscene, unprofessional, offensive, misleading or defamatory; or
• modify, reproduce, display, publish, distribute, copy, transmit, perform, license, create derivative works from, transfer, or sell or resell any information, content, software, or materials obtained from or made available through the Onlyhuman App, other than in accordance with these terms and conditions.
Availability
We will, to the best of our ability, ensure the Onlyhuman App is available for access at all times but are not responsible if you are not able to access the Onlyhuman App as a result of (i) us undertaking preventative or remedial maintenance or (ii) as a result of any circumstances beyond our control.
Security
We use a variety of internal technical security measures to protect your Personal Information. You should also take all precautionary measures when using our services to protect your Personal Information.

Onlyhuman App may from time to time contain links to other websites. These are provided for convenience only. We take no responsibility for the content and maintenance of, or privacy compliance by, any linked site. Any link to another site does not imply our endorsement, support, or sponsorship of the operator of that site nor of the information and/or products which they provide.
Intellectual Property
The copyright to all materials on the Onlyhuman App belongs to us. From time to time materials may be subject to specific usage rights and restrictions. We will notify you of any such rights and restrictions when you access the materials. Of course, you must only use the materials in accordance with those rights and subject to those restrictions.
Confidentiality and Privacy
When you become a registered user of Onlyhuman App you will be asked to provide some personal information. This information may be used by us and our contractors in connection with the App. While we take reasonable steps to preserve the security of your information, please be aware that we cannot guarantee your use of the Onlyhuman App will be confidential and we cannot guarantee that any information you provide to us is perfectly secure. Our Privacy Policy explains how we deal with your personal information that you provide to us or of which we become aware.
Monitoring use of Onlyhuman App
We reserve the right to monitor your use of Onlyhuman App for the purpose of ensuring that the Onlyhuman App is functioning as we intended and that you are complying with these terms and conditions.

Use of the Onlyhuman App is not a substitute for seeking and acting on medical advice provided by a qualified practitioner. Whilst we take all due care in providing Onlyhuman App, we do not provide any specific warranty, either express or implied, including without limitation warranties of merchantability or fitness for a particular purpose except as we are required to by the law of Australia. Whilst we use our best endeavours to identify and verify the correct source of materials made available through the Onlyhuman App of which we are not the author, we disclaim any responsibility with regard thereto. Any materials made available through the Onlyhuman App of which we are not the author is provided on an ‘as is basis’. We are not responsible for verifying the originality of any such material nor your use of any such material. We take all due care in ensuring that Onlyhuman App is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your device which arises in connection with your use of the Onlyhuman App or any linked site. To the extent permitted by the law of Australia, any guarantees, conditions or warranties which would otherwise be implied into these terms and conditions are excluded.
Limitation of Liability
We do not exclude or restrict our liability for any matter which it would be illegal for us to exclude or attempt to exclude our liability. However, we are not responsible for any injury (whether physical or mental) that occurs while you are using the Onlyhuman App. To the full extent permitted by the law of Australia, our liability for our breach of any guarantee, condition or warranty is limited to the supply of Onlyhuman App again or payment of the costs of having Onlyhuman App supplied again. We accept no liability for any loss caused in whole, or in part, by your misuse, abuse or improper application of the Onlyhuman App. We accept no liability for any loss of business opportunities, loss of profit, loss of business information, loss of reputation or goodwill or any other business interruption suffered by you as a result of your use of the Onlyhuman App. We do not accept liability for anything contained in a post you make on the Onlyhuman App or in any form of communication which originates with you and not with us.

Changes to these Terms and Conditions
We reserve the right to change these terms and conditions at any time. If you use Onlyhuman App following any amendment to these terms and conditions you will be taken to have agreed to comply with the terms and conditions as changed. We will take reasonable steps to let you know about any changes but you should also keep track of whether changes have been made to this policy by referring to the date of publication at the end of this page.
Termination
Your right to use Onlyhuman App will continue until it is terminated by the Company or you close your account. We reserve the right to suspend or terminate your right to use the Onlyhuman App if, at any time, you breach these terms and conditions.
Notices
Any notice we send to you will be emailed to the email address linked to your registration with Onlyhuman App.
General
If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect. These terms and conditions are to be governed by and construed in accordance with the laws of New South Wales and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in New South Wales. You agree to submit to the jurisdiction of the courts in New South Wales.

By accessing the App, you consent to the collection and use of the information you provide in the manner we describe in this policy. Meanings of terms used In this Privacy Policy: * • ‘we’, ‘us’ or ‘our’ refer to Epica Pty Ltd (ABN: 78 612 184 335). * • ‘you’ or ‘your’ refer to the subscriber to the Onlyhuman App. * • ‘Onlyhuman App’ means our software application and the related services that you will be able to access and use once you conclude the registration process. * • ‘Site’ means our website, www.onlyhumanapp.com. * • ‘Personal Information’ has the meaning given to it in the Privacy Act 1988 (Cth) (Act). In general terms, it is any information that can be used to personally identify you. This may include (but is not limited to) your name and contact details (including phone numbers and email addresses). If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.
What data do we collect and process?
We collect Personal Information about you and other subscribers of the Onlyhuman App. The most common types of information we collect are things like your: * • name * • email address; * • phone number; * • date of birth; and * • any additional information relating to you that you provide to us directly or indirectly through use of the Onlyhuman App.
When do we collect personal information?
We collect personal information when you provide it to us during the registration process and at other times as you use the Onlyhuman App or contact us. We also collect personal information from other third party service providers to us. We also use cookies and other technologies to provide us with information the way in which you navigate the Onlyhuman App. (not to sure what you mean here) If you choose not to provide personal information at the time you are seeking to register as a user of the Onlyhuman App, you will not be able to complete the registration process to access and use the Onlyhuman App.
For what purpose do we collect and process this data?
We will use your Personal Information to: * • verify your identity when you register; * • provide services to you through the Onlyhuman App including the ability to share information with third parties selected by you; * • facilitate and process other transactions that take place on the Onlyhuman App; * • respond to support requests; * • help facilitate the resolution of any disputes; * • update you with operational news and information about the Onlyhuman App including web App disruptions or security updates; * • provide you with information that you request from us; * • provide you with marketing information about products and services which we think may interest you; * • determine how to improve the Onlyhuman App to help it better serve you; * • monitor activity on the Onlyhuman App, including to identify potential fraudulent activity and to ensure compliance with the terms and conditions that apply to the Onlyhuman App; * • manage our legal and operational affairs; * • provide general administrative and performance functions and activities; and * • to study the effectiveness of the Onlyhuman App. In addition, we will disclose your Personal Information to third parties as follows: * • where it is reasonably necessary in order to enable us to make the Onlyhuman App available to you; and * • when we are required to do so by law. How can users request deletion of their data?
At any time you can email us at contact@onlyhumanapp.com to have your data and account deleted. Our representative will contact you within a reasonable time after receipt of your request to confirm the process has been completed. We will aim to ensure that your request is resolved in a timely and appropriate manner.
What happens if the ownership of our business changes?
As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganisation, dissolution or similar event, Personal Information may be part of the transferred assets. You acknowledge and agree that any successor to or acquirer of our business (or its assets) will continue to have the right to use your Personal Information and other information in accordance with the terms of this Privacy Policy.
Do we collect information from children?
We do not knowingly collect Personal Information from children under the age of 16. If you are under the age of 16, please do not submit any Personal Information to us. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Information to us without their permission. If you have reason to believe that a child under the age of 16 has provided Personal Information to us, please contact us, and we will endeavour to delete that information from our database.

The Onlyhuman App may be maintained in a country that is not Australia (on a temporary or permanent basis). By registering as a user of and accessing the Onlyhuman App, you agree: * • to and authorise us giving your personal information, in accordance with this policy, to a third party who is not in Australia or a third party who may transfer and store outside Australia your personal information (Overseas Recipient); * • that, while we will take reasonable steps to ensure that an Overseas Recipient does not breach the APPs, Overseas Recipients are not bound by the APPs and subclause 8.1 of the APPs does not apply to the disclosure of your personal information to an Overseas Recipient*; and * • that, if an Overseas Recipient handles your information in breach of the APPs, you will not be able to seek redress under the Act. *Subclause 8.1 of the APPs requires us to ensure that Overseas Recipients comply with the APPs unless, in accordance with subclause 8.2, you agree otherwise. How can you access your personal information?
You can access some of the information that we collect about you by logging in to your account on the Onlyhuman App. You also have the right to make a request to access other information we hold about you and to request corrections of any errors in that information. Will this policy be updated?
We may need to change this policy from time to time in order to make sure it stays up to date with the latest legal requirements and any changes to our management of privacy. When we do amend the policy, the changes will be effective straightaway. We will take reasonable steps to let you know about any changes made to this policy. We also suggest that you revisit this policy from time to time to see whether or not changes have been made. If you continue to use the Onlyhuman App after the changes are made, then you will be agreeing to the changes.
